In any case, with the exception of binding regulations, Trends Forecasting S.r.l. is not liable for damages that may result to the contracting party for the improper use of access authentication tools.
The supplier is entitled to suspend or revoke authorizations that are granted to the user, in case the user violates its assumed obligations made in accordance with the Legal notice hereof and in accordance with any other contractual disposition, law regulation, either general or special, or other rules and regulations set up for the services provided through the website.
10. APPLICABLE LAWS AND CONSUMER PROTECTION

CONDIZIONI DI CONTRATTO PER L’ABBONAMENTO ALLE RIVISTE TJF MAGAZINE E TJF TREND BOOK
1) Premessa
Il presente contratto fa riferimento alla disciplina relativa al commercio elettronico. A tal fine, come previsto dall’art. 7 del D.lgs. n. 70 del 9 aprile 2003 (attuazione della direttiva 2000/31/CE), si forniscono le seguenti informazioni:

2) Definizioni
Ai fini di cui al presente Contratto i seguenti termini sono intesi e interpretati come segue:
a) Per “Fornitore” si intende la Società Trends Forecasting S.r.l.
b) Per “Contraente” si intende la persona fisica o giuridica (società, associazione, fondazione, archivio, etc.) in persona del rappresentante legale pro tempore, che effettua l’Ordine;
c) Per “Riepilogo d’ordine” si intende il documento, anche solo elettronico, contenente le indicazioni relative al prezzo del servizio ed alle modalità di pagamento. Il Riepilogo dell’ordine costituisce parte integrante del presente contratto;
d) Per “Ordine” si intende il documento, anche solo elettronico, inviato, anche solo telematicamente, dal contraente attestante la sua volontà di effettuare l’offerta contrattuale secondo le specifiche indicate nel Riepilogo dell’ordine ed alle condizioni contrattuali di regolamentazione stabilite per l’anno per il quale si chiede l’abbonamento. L’ordine costituisce parte integrante del presente contratto;
e) Per “Ricevuta dell’ordine” si intende la comunicazione telematica inviata dal fornitore al contraente attestante l’accettazione dell’Ordine. La Ricevuta dell’ordine costituisce parte integrante del presente contratto;
f) Per “materiali” si intendono i contenuti, in qualsiasi forma o modo espressi, nel loro insieme e nelle singole parti, messi a disposizione del contraente via rete telematica su sua richiesta, relativamente ai quali è concessa al contraente una licenza d’uso non esclusiva nei modi e nei termini stabiliti nel presente contratto;
g) Per “materiali correnti” si intendono i materiali che rappresentano la versione elettronica (file) dell’insieme degli articoli pubblicati nella rivista alla quale il contraente è abbonato, relativamente ai numeri della rivista acquistati con un abbonamento annuale in corso di validità nella formula “carta + on line”;
h) Per “riviste” si intendono i periodici editi dal Fornitore.
3) Oggetto e Durata
Il presente contratto ha ad oggetto alternativamente o cumulativamente l’abbonamento alle riviste TJF Magazine, TJF Trend Book e l’accesso ad ulteriori materiali e servizi presenti sul sito www.tjfgroup.com.
La sottoscrizione dell’abbonamento consente di accedere alle sezioni riservate della/e rivista/e prescelta/e per la durata corrispondente a quella di abbonamento prescelto decorrenti dalla data di comunicazione della password.
Una volta sottoscritto l’abbonamento e corrisposto il relativo importo, all’abbonato verranno trasmesse via e-mail il nome utente e la password per accedere alla sezioni riservate della della/e rivista/e prescelta/e. Decorso il termine di abbonamento l’accesso concesso alle sezioni riservate della/e rivista/e può cessare con effetto immediato e senza preavviso da parte del fornitore.
4) Perfezionamento ed efficacia
Il presente contratto elettronico si perfeziona nel momento in cui il fornitore accetta l’Ordine inviato telematicamente dal contraente. La parte richiedente dovrà selezionare la rivista per la quale intende abbonarsi e la relativa durata di abbonamento, cliccare sul pulsante “order” e compilare il modulo di sottoscrizione. Il fornitore confermerà la sottoscrizione con comunicazione dell’avvenuto perfezionamento del contratto che sarà inviata tramite e-mail all’indirizzo di posta elettronica che la parte richiedente avrà indicato nel modulo di iscrizione.
L’efficacia del presente contratto rimane sospesa fino all’avvenuta registrazione e abilitazione del contraente tramite il sito internet del fornitore. Nella mail di conferma il Fornitore invierà anche la nota pro forma relativa al servizio offerto, che dovrà essere saldata entro e non oltre 9 (nove) giorni; in mancanza, il contratto si intenderà automaticamente risolto.
5) Esecuzione
L’accesso alle sezioni riservate avviene tramite autenticazione del numero Internet Protocol (Ip) del contraente, come da questi dichiarato. Il numero di Ip del contraente deve riferirsi ad un singolo computer o rete locale del contraente.
Qualsiasi violazione del presente accordo circa la natura e le caratteristiche dell’Ip e/o della rete locale del contraente costituisce inadempimento grave del contraente e legittima la risoluzione del presente contrato per sua colpa.
Qualora il contraente sia una persona fisica che agisce per scopi estranei all’attività imprenditoriale o professionale, il contratto sarà soggetto agli artt. 50 ss. del D. Lgs 6 settembre 2005, n. 206 “Codice del Consumo”.
6) Licenza d’uso e riserva di copyright
Tutti i materiali sono oggetto di proprietà intellettuale e/o industriale spettante alla società Trends Forecasting S.r.l.. Salvo quanto espressamente autorizzato dal presente contratto, ogni azione riservata al titolare dei diritti dalle leggi nazionali e internazionali, compiuta senza la sua autorizzazione, sarà perseguibile civilmente e penalmente.
I materiali contenuti nell’area riservata sono concessi in licenza d’uso non esclusiva e non trasferibile secondo quanto di seguito specificato:
a) È autorizzata la realizzazione di una sola copia digitale permanente dei materiali. La realizzazione di tale copia avviene con l’operazione di downloading. E’ vietata qualsiasi ulteriore copia digitale e/o elettronica e/o magnetica, totale o parziale, dei materiali;
b) E’ autorizzata la stampa dei materiali unicamente a opera degli Utenti autorizzati per uso strettamente personale, purché agiscano senza scopo di lucro e senza fini direttamente od indirettamente commerciali;
c) Sono vietati la modifica dei materiali e/o il loro utilizzo per l’elaborazione di opere derivate, composite o complesse senza la previa autorizzazione scritta della società Trends Forecasting S.r.l..
In ogni riproduzione dei materiali deve essere mantenuta inalterata ogni informazione relativa alla titolarità del diritto d’autore.
Trends Forecasting S.r.l. si riserva di sospendere immediatamente l’abbonamento ritenuto fonte di illecito approvvigionamento.
7) Prezzo e Modalità di Pagamento
7.1 Abbonamento alla rivista TJF Magazine.
L’abbonamento per un anno alla rivista, pari a 5 numeri della stessa, è di € 56,00.
L’abbonamento per due anni alla rivista è di € 106,00.
Tali prezzi non sono comprensivi di tasse e spese di spedizione. In caso di conversione in sterline o dollari saranno soggetti al valore di cambio al momento della sottoscrizione.
7.2 Abbonamento a TJF Trend Book.
L’abbonamento a TJF Trend Book 2009 + TJF Trend Book 2008 + TJF Trend Book 2007 + 1 anno di abbonamento gratis alla rivista TJF Magazine è di € 1.100,00.
L’abbonamento a TJF Trend Book 2007 (fino ad esaurimento) è di € 100,00.
L’abbonamento a TJF Trend Book 2008 + 1 anno di abbonamento gratis alla rivista TJF Magazine è di € 400,00.
L’abbonamento a TJF Trend Book 2009 + 1 anno di abbonamento gratis alla rivista TJF Magazine è di € 750,00.
Tali prezzi non sono comprensivi di tasse e spese di spedizione. In caso di conversione in sterline o dollari saranno soggetti al valore di cambio al momento della sottoscrizione.
7.3 Il corrispettivo dovrà essere versato entro e non oltre 9 (nove) giorni decorrenti dal ricevimento della e-mail da parte di TJF Group relativa alla conferma di iscrizione e contenente anche la nota pro forma per il servizio.
Il versamento potrà essere effettuato :
a) con bonifico bancario sul conto corrente intestato a Trends Forecasting srl acceso presso Banca Etruria Arezzo, Agenzia 12 Branch, Swift : ARBAIT33148, Abi: 05390, Cab: 14112, IBAN: IT15R0539014112000000001112.
b) Tramite carta di credito
7.4 All’atto del pagamento dell’intero importo sarà inviata al cliente, anche tramite posta elettronica all’indirizzo indicato dal cliente, regolare fattura a saldo.
7.5 Clausola risolutiva espressa: il mancato pagamento da parte del cliente entro il termine di 9 (nove) giorni comporterà l’automatica risoluzione del contratto; pertanto Trends Forecasting S.r.l. potrà eliminare il cliente dalla piattaforma senza alcun preavviso e senza alcuna comunicazione al riguardo.
8) Dichiarazioni, garanzie e responsabilità
Il sito www.tjfgroup.com ed il servizio online sono gestiti da Trends Forecasting S.r.l. con la massima attenzione, affidabilità e professionalità.
Il Fornitore dichiara che al meglio delle sue conoscenze l’uso dei materiali secondo le norme di cui al presente contratto non lede diritti di terzi.
Fermo restando quanto sopra, il Fornitore esclude espressamente, in relazione ai materiali, così come ai file che li contengono, ogni garanzia e condizione, espressa, implicita o statutaria, incluse, fra le altre, le garanzie implicite e/o le condizioni di commerciabilità, di qualità soddisfacente, di idoneità al soddisfacimento di uno scopo specifico, di esenzione da vizi o difetti, di precisione.
Si fa presente che Internet non é posseduta dal Fornitore che pertanto non si farà carico di eventuali accessi al server in cui vengono ospitati i siti di TJF Group da parte di un utilizzatore qualsiasi.
Il Fornitore si impegna comunque a rimediare con la massima sollecitudine ad eventuali guasti di rete o ad altri malfunzionamenti come ad esempio anomalie nel collegamento telematico, anomalie del circuito internet, anomalie derivanti da cause di forza maggiore, da comportamenti colposi di terzi.
Il Fornitore non può inoltre garantire che il servizio sia sempre accessibile senza interruzioni e che si possa sempre instaurare la connessione richiesta.
Il Fornitore, inoltre, qualora sia necessario effettuare lavori di manutenzione ordinaria o straordinaria del sito, potrà sospendere temporaneamente la sua (o le sue) rete telecomunicativa od a limitarne la durata.
Sono escluse eventuali richieste di risarcimento danni nei confronti di Trends Forecasting S.r.l.., salvo che il danno derivi da dolo o colpa grave.
Il Fornitore non si assume alcuna responsabilità relativamente alla veridicità dei dati inseriti dal cliente finale nella sua richiesta, in particolare sulla reale esistenza del cliente finale sotto il nome e l’indirizzo specificati.
9) Responsabilità del contraente per l’accesso tramite il suo Ip, l’uso di Id e di password
Il contraente è obbligato nei confronti del Fornitore ad attenersi alla massima diligenza nell’uso e nella custodia dell’Id e della password assegnati e alla sicurezza dell’Ip dichiarato ed è pertanto responsabile di tutte le conseguenze connesse all’eventuale loro uso abusivo o contrario alle norme di cui al presente contratto. In caso di smarrimento, di furto o di fondato timore che l’Id o la password assegnate (ovvero la sola password) siano venute a conoscenza di terzi, il contraente è tenuto a darne immediata comunicazione al fornitore affinché lo stesso provveda, nel minor tempo tecnicamente richiesto, a una nuova assegnazione o configurazione. Il fornitore si riserva la facoltà di sospendere le autorizzazioni di accesso fino al loro ripristino. Salve le norme inderogabili di legge, il fornitore non è in ogni caso responsabile dei danni che possano derivare al contraente per l’uso improprio degli strumenti di autenticazione dell’accesso.
Il fornitore si riserva di sospendere o revocare le autorizzazioni concesse in caso di violazione degli obblighi assunti dal contraente ai sensi del predetto contratto e di ogni disposizione contrattuale o di legge, generale o speciale, di disciplina dell’accesso ai materiali.
10) Privacy
Nel rispetto del Codice in materia di protezione dei dati personali (D.Lgs. 196/03), Trends Forecasting S.r.l. garantisce la massima riservatezza nel trattamento, manuale ed informatico, dei dati personali, utilizzati per l’ordinaria gestione commerciale e per l’invio di cataloghi e altro materiale gratuito, oltre che, ove specificamente indicato nelle singole sezioni web, per altre finalità ivi espresse e correlate alla fruizione dei servizi specificamente richiesti dall’interessato. Per lo svolgimento dell’attività il Fornitore si avvale dei propri dipendenti e di soggetti esterni incaricati, o responsabili, di trattare i dati per le predette finalità.
Il cliente presta il suo consenso al fatto che tutti i dati personali necessari alla sottoscrizione dell’abbonamento ed all’accesso ai materiali riservati presenti sul portale www.tjfgroup.com vengano elaborati e memorizzati informaticamente.
Il cliente gode dei diritti di cui all’art. 7 del D.Lgs. citato, in virtù dei quali potrà chiedere ed ottenere, tra l’altro, informazioni circa i dati che lo riguardano e circa le modalità o le finalità del trattamento; potrà anche chiedere l’aggiornamento, la rettifica, l’integrazione, la cancellazione, l’anonimizzazione ed il blocco dei dati e potrà infine opporsi al trattamento degli stessi. Tali diritti dovranno esercitati rivolgendosi al Titolare del trattamento, la società Trends Forecasting S.r.l., via Einstein 16/A, 52100 Arezzo.
11) Legge applicabile, conciliazione ed arbitrato
Il presente contratto è soggetto alla legge italiana ovvero a quella del paese del contraente qualora quest’ultima imponga la sua applicazione ai fini del riconoscimento della validità e/o dell’efficacia del presente contratto.
Tutte le controversie derivanti dal presente contratto, comprese quelle relative alla sua validità, interpretazione, esecuzione e risoluzione, saranno devolute al tentativo di conciliazione previsto dal Servizio di Conciliazione Online della Camera Arbitrale di Arezzo Nel caso in cui il tentativo di conciliazione non fosse raggiunto, la controversia sarà risolta da un arbitro unico, in conformità al Regolamento della Camera Arbitrale di Arezzo che può essere consultato sul sito………..La sede dell’arbitrato è fissata presso la Camera Arbitrale di Arezzo . L’arbitro unico deciderà in via rituale e secondo diritto.
12) Disposizioni finali
Eventuali modifiche e/o integrazioni al presente contratto dovranno essere approvate per iscritto da entrambe le parti.
Per tutte le controversie con i consumatori resta salva l’applicazione delle norme imperative di legge in materia di competenza giurisdizionale e di legge applicabile.
Le presenti condizioni contrattuali sono state redatte in lingua italiana. Qualora la traduzione in lingua inglese possa portare ad errori di interpretazione o ad altri errori, fa fede la versione italiana.
AGREEMENT CONDITIONS FOR SUBSCRIBING TO TJF MAGAZINE AND TJF TREND BOOK
1) Introduction
The agreement hereof refers to the rules and regulations relative to e-commerce. To that end, as provided by article 7 of Legislative Decree no. 70 dated April 9th 2003 (implementation of Directive 200/31/EC), the following information is provided: TRENDS FORECASTING S.r.l., with headquarters in Arezzo, via Einstein no. 16/A.

2) Definitions
For agreement purposes, the following terms are understood and interpreted as follow:
a) The “Supplier” is the Firm Trends Forecasting S.r.l.
b) The “Contracting Party” is the individual or legal person (company, association, institution, record office, etc.) in the place of the legal representative pro tempore, who makes the Order;
c) “Order summary” is a document, including electronic ones; this document contains indications about the price for the services and the payment terms. The Order summary is an integral part of the agreement hereof;
d) An “Order” is a document that is sent by computer and is where the contracting party attests its willingness to make a contractual offer according to the specifications indicated on the Order Summary and according to the contractual conditions agreed for the year in which the subscription is requested. An Order is an integral part of the agreement hereof;
e) “Order Receipt” is a communication sent by the supplier to the contracting party, wherein it confirms the acceptance of the Order. The Order Receipt is an integral part of the agreement hereof;
f) “Materials” are the contents, under any form or expression, entirely or in single parts, that are made available to the contracting party through a network, upon its own request; the contracting party is provided with a user licence, which is not exclusive under the terms and conditions established on this agreement;
g) “Current Materials” are materials that account for the electronic versions (files) of the whole series of articles that are published in the magazine, which the contracting party subscribes to and relatively to the number of the magazines purchased with the yearly subscription, which are effective under the formula "paper + on line";
h) “Magazines” are the magazines that are published by the Supplier.
3) Subject-matter and Period
The agreement’s subject-matter is alternatively or cumulatively the subscription to TJF Magazine, TJF Trend Book and the access to additional materials and services that are available on the website www.tjfgroup.com.
By signing the subscription, the user can access the reserved sections of the chosen magazine for the period corresponding to that of the selected subscription, effective from the date in which the password is provided.
Once the user subscribes and pays the respective price, the subscriber will be provided (by email) with a user name and a password so that it can access the reserved sections of the selected magazine. After the subscription expires, the access granted to the reserved sections of the magazine may stop immediately without receiving a prior notice from the supplier.
4) Improvement and effectiveness
This electronic agreement will be completed when the supplier accepts the Order that is sent by the contracting party by means of computer. The party who applies shall select the magazine that wishes to subscribe to and the respective subscription period; click on the "order" button and fill out the subscription form. The supplier will confirm the subscription with a communication stating that the agreement will be completed and it will forward it with an email sent to the email address that the applicant listed on the subscription form.
The effect of this agreement will be pending until the contracting party registers through the supplier's website. The Supplier will also send a pro-forma invoice for the services offered, it shall be paid by no later than 9 (nine) days, otherwise the agreement will be considered automatically annulled.
5) Execution
The access to the reserved sections is done by authenticating the contracting party’s Internet Protocol (IP) number, as declared by the contracting party. The contracting party’s IP number must refer to a single computer or network.
Any violation to the agreement made on the nature and the characteristics of the contracting party’s IP and/or local network will account for a serious non-fulfilment by the contracting party and will justify the termination of the agreement because of such offence.
If the contracting party is an individual who operates for purposes other than entrepreneurial activity or professional activity, the agreement will be then subjected to articles 50 ss. of Legislative Decree dated September 2005 and article no. 206 “The Consumer Code”.
6) User licence and copyrights
All materials are subjected to intellectual property rights and/or patent rights and belong to Trends Forecasting S.r.l. With the exception of what is authorized under this agreement, any act of national or international laws reserved to the proprietor and that are carried out without the proprietor’s authorization will be prosecuted under civil or criminal proceedings.
The materials in the reserved area are granted under the user licence, which is not exclusively and cannot be transferred according to the following specifications:
a) The material may only be copied digitally once. Such copy may be downloaded from the website. Any additional digital, electronic or magnetic copy, either total or partial is forbidden;
b) The materials may only be printed by authorized Users and for strictly personal purposes, without profit and may not be used for commercial purposes, directly or indirectly.
c) The materials and/or its usage may not be modified in any way to work with derived, composite or complex activities without prior written authorization provided by Trends Forecasting S.r.l.
Any copied material must maintain the information relative to the copyright legal ownership.
Trends Forecasting S.r.l. reserves the right to suspend the subscription immediately if supplied illegitimately.
7) Price and Payment Terms
7.1 Subscribing to TJF Magazine.
The yearly subscription for the magazine is equal to 5 issues and costs € 56.00.
A two-year subscription to the magazine costs € 106.00.
Prices include taxes and shipping charges. If prices need to be converted into pounds or dollars they shall be subjected to the exchange rate at the time of the subscription.
7.2 Subscribing to TJF Trend Book.
The subscription to TJF Trend Book 2009 + TJF Trend Book 2008 + TJF Trend Book 2007 + a year’s free subscription to TJF Magazine costs € 1,1000.00.
Thee subscription to TJF Trend Book 2007 (while stocks last) costs € 100.00.
The subscription to TJF Trend Book 2008 + a year’s free subscription to TJF Magazine costs € 400.00.
The subscription to TJF Trend Book 2009 + a year’s free subscription to TJF Magazine costs € 750.00.
Prices include taxes and shipping charges. If prices need to be converted into pounds or dollars they shall be subjected to the exchange rate at the time of the subscription.
7.3 The payment shall be paid by no later than 9 (nine) days after receipt of an email from TJF Group therein stating the subscription confirmation, which also includes a pro forma invoice for the services.
The payment shall be made as follow:
a) by means of a bank transfer to the current account in the name of Trends Forecasting srl at Banca Etruria Arezzo, Agency 12 Branch, Swift: ARBAIT33148, Abi (Italian Banking Association): 05390, Cab (Bank Sorting Code): 14112, IBAN: IT15R0539014112000000001112.
b) By credit card
7.4 When the payment is paid in full, the customer will also receive a standard invoice, it will be sent to the email address that was indicated by the customer.
7.5) Expressed resolutive clause: if the customer does not make the payment within 9 (nine) days, the agreement will be automatically terminated and therefore Trends Forecasting S.r.l. can remove the customer from the platform without giving any prior notice.
8) Declarations, guarantees and obligations
The website www.tjfgroup.com and the online services are managed by Trends Forecasting S.r.l with the utmost care, reliability and professionalism.
The Supplier declares that to the best of its knowledge, the use of the materials according to standards on the agreement hereof, does not harm third parties rights.
In consideration of the above stated, the Supplier explicitly excludes any expressed, implied or statute warranties or conditions about the materials and files that contain them, including among others, implied warranties and/or commercial conditions, acceptable quality conditions, conditions that fulfil a specific goal and conditions that exempt accuracy defects or faults.
Please note that the Internet is not owned by the Supplier and therefore it will not be liable for any access to the server wherein websites from TJF Group are hosted by any user.
In any case, the Supplier commits itself to remedying any network failures or any other malfunctioning with the utmost promptness, as for example, connection problems, internet circuit problems, issues due to force majeure and problems due to third parties behaviour without malice aforethought.
Moreover, the Supplier cannot guarantee that the service will always be accessible without interruptions and it cannot ensure that the connection requested will always be established.
If ordinary or extraordinary maintenance need to be carried out on the website, the supplier may temporarily interrupt the network/s or limit its period.
Any compensation for damages against Trends Forecasting S.r.l. are not admitted, except if the damage is due to fraud or gross negligence.
The Supplier will not be held liable in any way for the veracity of the data input by the final customer on its request, especially for the actual existence of the final customer under such specified name and address
9) The contracting party’s obligations for accessing using its IP, ID and password
The contracting party must be very careful while using and keeping the ID and the password that are provided by Trends Forecasting S.rl., as well as the declared IP; the user is therefore liable for all consequences linked with any “abusive" use that does not comply with the regulations of this agreement. If they are lost, stolen or if the user fears that a third party has come to know the ID or password, the user must then inform Trends Forecasting S.r.l immediately so that they can assigned a new password or configure it in the shortest time technically required. The supplier reserves the right to suspend access authorizations until they are restored. In any case, with the exception of binding regulations, the Supplier is not liable for damages that may result to the contracting party for the improper use of access authentication tools.
The supplier reserves the right to suspend or revoke authorizations that are granted to the contracting party, in case the user violates its assumed obligations made in accordance with the aforesaid agreement and in accordance with any contractual disposition, law regulation, either general or special or rules to follow for accessing the materials.
10) Privacy
In order to comply with the Code concerning the protection of personal data (Legislative Decree 196/03), Trends Foreasting S.r.l guarantees the utmost privacy for the treatment of data, either manually and by means of a computer, that is used for normal commercial management and used for sending catalogues and other free of charge materials, as well as, wherein specifically requested on the single web sections, it may be also be used for other purposes, therein expressed and connected to the rendering of services that is specifically requested by the interested party. In order to carry out such activities, the Supplier uses its own employees and external assigned subjects or persons in charge for handling the data for such purposes.
The customer gives its consent to the fact that all personal data required for the subscription and to gain access to the reserved materials available on the website www.tjfgroup.com will be processed and stored by means of a computer.
The customer is entitled to the rights mentioned on article 7 of Legislative Decree, wherein it can request and obtain, among other things, information about the data that concerns the customer and data about the procedures and the purpose of the treatment; it may also request to update, correct, add, delete or be anonymous and obstruct the data and can eventually oppose the treatment of the data itself. These rights must be exercised by contacting the subject in charge of the data treatment, Trends Forecasting S.r.l, via Einstein 16/A, 52100 Arezzo.
11) Applicable laws, settlement and arbitration
The agreement hereof is subjected to Italian laws, or to the laws wherein the user resides if the latter imposes its application for purposes of recognizing the agreement’s validity and/or effectiveness.
Any disputes derived from this agreement, including those relative to its validity, interpretation, execution and termination, will try to be settled according to the Online Settlement Service of the Arbitration Board of Arezzo If the attempt for settlement is not possible, the dispute will be settled by a sole arbitrator, in accordance with the Regulations of the Arbitration Board of Arezzo , which can be looked up on the website ........... The arbitration location will be arranged by the Arbitration Board of Arezzo The sole arbitrator will settle the disputes through a ritual arbitration and a rights arbitration.
12) Final Provisions
Any modifications and/or additions made to this agreement must be approved in writing by both parties.
All disputes with consumers will apply to binding laws of legal competence and applicable laws.
The contractual conditions hereof have been written in the Italian language. If the English translation leads to interpretation errors or any other type of errors, then the Italian version shall prevail.

Trends Forecasting S.r.l. is entitled to suspend access authorizations until they are restored. In any case, with the exception of binding regulations, Trends Forecasting S.r.l. is not liable for damages that may result to the contracting party for the improper use of access authentication tools.
The supplier is entitled to suspend or revoke authorizations that are granted to the user, in case the user violates its assumed obligations made in accordance with the Legal notice hereof and in accordance with any other contractual disposition, law regulation, either general or special, or other rules and regulations set up for the services provided through the website.
10. APPLICABLE LAWS AND CONSUMER PROTECTION
This Legal notice is subjected to Italian laws, or to laws wherein the user resides if the latter imposes its application for purposes of recognizing its validity and/or effectiveness. CONDIZIONI DI CONTRATTO PER L’ABBONAMENTO ALLE RIVISTE TJF MAGAZINE E TJF TREND BOOK
1) Premessa
Il presente contratto fa riferimento alla disciplina relativa al commercio elettronico. A tal fine, come previsto dall’art. 7 del D.lgs. n. 70 del 9 aprile 2003 (attuazione della direttiva 2000/31/CE), si forniscono le seguenti informazioni:

2) Definizioni
Ai fini di cui al presente Contratto i seguenti termini sono intesi e interpretati come segue:
a) Per “Fornitore” si intende la Società Trends Forecasting S.r.l.
b) Per “Contraente” si intende la persona fisica o giuridica (società, associazione, fondazione, archivio, etc.) in persona del rappresentante legale pro tempore, che effettua l’Ordine;
c) Per “Riepilogo d’ordine” si intende il documento, anche solo elettronico, contenente le indicazioni relative al prezzo del servizio ed alle modalità di pagamento. Il Riepilogo dell’ordine costituisce parte integrante del presente contratto;
d) Per “Ordine” si intende il documento, anche solo elettronico, inviato, anche solo telematicamente, dal contraente attestante la sua volontà di effettuare l’offerta contrattuale secondo le specifiche indicate nel Riepilogo dell’ordine ed alle condizioni contrattuali di regolamentazione stabilite per l’anno per il quale si chiede l’abbonamento. L’ordine costituisce parte integrante del presente contratto;
e) Per “Ricevuta dell’ordine” si intende la comunicazione telematica inviata dal fornitore al contraente attestante l’accettazione dell’Ordine. La Ricevuta dell’ordine costituisce parte integrante del presente contratto;
f) Per “materiali” si intendono i contenuti, in qualsiasi forma o modo espressi, nel loro insieme e nelle singole parti, messi a disposizione del contraente via rete telematica su sua richiesta, relativamente ai quali è concessa al contraente una licenza d’uso non esclusiva nei modi e nei termini stabiliti nel presente contratto;
g) Per “materiali correnti” si intendono i materiali che rappresentano la versione elettronica (file) dell’insieme degli articoli pubblicati nella rivista alla quale il contraente è abbonato, relativamente ai numeri della rivista acquistati con un abbonamento annuale in corso di validità nella formula “carta + on line”;
h) Per “riviste” si intendono i periodici editi dal Fornitore.
3) Oggetto e Durata
Il presente contratto ha ad oggetto alternativamente o cumulativamente l’abbonamento alle riviste TJF Magazine, TJF Trend Book e l’accesso ad ulteriori materiali e servizi presenti sul sito www.tjfgroup.com.
La sottoscrizione dell’abbonamento consente di accedere alle sezioni riservate della/e rivista/e prescelta/e per la durata corrispondente a quella di abbonamento prescelto decorrenti dalla data di comunicazione della password.
Una volta sottoscritto l’abbonamento e corrisposto il relativo importo, all’abbonato verranno trasmesse via e-mail il nome utente e la password per accedere alla sezioni riservate della della/e rivista/e prescelta/e. Decorso il termine di abbonamento l’accesso concesso alle sezioni riservate della/e rivista/e può cessare con effetto immediato e senza preavviso da parte del fornitore.
4) Perfezionamento ed efficacia
Il presente contratto elettronico si perfeziona nel momento in cui il fornitore accetta l’Ordine inviato telematicamente dal contraente. La parte richiedente dovrà selezionare la rivista per la quale intende abbonarsi e la relativa durata di abbonamento, cliccare sul pulsante “order” e compilare il modulo di sottoscrizione. Il fornitore confermerà la sottoscrizione con comunicazione dell’avvenuto perfezionamento del contratto che sarà inviata tramite e-mail all’indirizzo di posta elettronica che la parte richiedente avrà indicato nel modulo di iscrizione.
L’efficacia del presente contratto rimane sospesa fino all’avvenuta registrazione e abilitazione del contraente tramite il sito internet del fornitore. Nella mail di conferma il Fornitore invierà anche la nota pro forma relativa al servizio offerto, che dovrà essere saldata entro e non oltre 9 (nove) giorni; in mancanza, il contratto si intenderà automaticamente risolto.
5) Esecuzione
L’accesso alle sezioni riservate avviene tramite autenticazione del numero Internet Protocol (Ip) del contraente, come da questi dichiarato. Il numero di Ip del contraente deve riferirsi ad un singolo computer o rete locale del contraente.
Qualsiasi violazione del presente accordo circa la natura e le caratteristiche dell’Ip e/o della rete locale del contraente costituisce inadempimento grave del contraente e legittima la risoluzione del presente contrato per sua colpa.
Qualora il contraente sia una persona fisica che agisce per scopi estranei all’attività imprenditoriale o professionale, il contratto sarà soggetto agli artt. 50 ss. del D. Lgs 6 settembre 2005, n. 206 “Codice del Consumo”.
6) Licenza d’uso e riserva di copyright
Tutti i materiali sono oggetto di proprietà intellettuale e/o industriale spettante alla società Trends Forecasting S.r.l.. Salvo quanto espressamente autorizzato dal presente contratto, ogni azione riservata al titolare dei diritti dalle leggi nazionali e internazionali, compiuta senza la sua autorizzazione, sarà perseguibile civilmente e penalmente.
I materiali contenuti nell’area riservata sono concessi in licenza d’uso non esclusiva e non trasferibile secondo quanto di seguito specificato:
a) È autorizzata la realizzazione di una sola copia digitale permanente dei materiali. La realizzazione di tale copia avviene con l’operazione di downloading. E’ vietata qualsiasi ulteriore copia digitale e/o elettronica e/o magnetica, totale o parziale, dei materiali;
b) E’ autorizzata la stampa dei materiali unicamente a opera degli Utenti autorizzati per uso strettamente personale, purché agiscano senza scopo di lucro e senza fini direttamente od indirettamente commerciali;
c) Sono vietati la modifica dei materiali e/o il loro utilizzo per l’elaborazione di opere derivate, composite o complesse senza la previa autorizzazione scritta della società Trends Forecasting S.r.l..
In ogni riproduzione dei materiali deve essere mantenuta inalterata ogni informazione relativa alla titolarità del diritto d’autore.
Trends Forecasting S.r.l. si riserva di sospendere immediatamente l’abbonamento ritenuto fonte di illecito approvvigionamento.
7) Prezzo e Modalità di Pagamento
7.1 Abbonamento alla rivista TJF Magazine.
L’abbonamento per un anno alla rivista, pari a 5 numeri della stessa, è di € 56,00.
L’abbonamento per due anni alla rivista è di € 106,00.
Tali prezzi non sono comprensivi di tasse e spese di spedizione. In caso di conversione in sterline o dollari saranno soggetti al valore di cambio al momento della sottoscrizione.
7.2 Abbonamento a TJF Trend Book.
L’abbonamento a TJF Trend Book 2009 + TJF Trend Book 2008 + TJF Trend Book 2007 + 1 anno di abbonamento gratis alla rivista TJF Magazine è di € 1.100,00.
L’abbonamento a TJF Trend Book 2007 (fino ad esaurimento) è di € 100,00.
L’abbonamento a TJF Trend Book 2008 + 1 anno di abbonamento gratis alla rivista TJF Magazine è di € 400,00.
L’abbonamento a TJF Trend Book 2009 + 1 anno di abbonamento gratis alla rivista TJF Magazine è di € 750,00.
Tali prezzi non sono comprensivi di tasse e spese di spedizione. In caso di conversione in sterline o dollari saranno soggetti al valore di cambio al momento della sottoscrizione.
7.3 Il corrispettivo dovrà essere versato entro e non oltre 9 (nove) giorni decorrenti dal ricevimento della e-mail da parte di TJF Group relativa alla conferma di iscrizione e contenente anche la nota pro forma per il servizio.
Il versamento potrà essere effettuato :
a) con bonifico bancario sul conto corrente intestato a Trends Forecasting srl acceso presso Banca Etruria Arezzo, Agenzia 12 Branch, Swift : ARBAIT33148, Abi: 05390, Cab: 14112, IBAN: IT15R0539014112000000001112.
b) Tramite carta di credito
7.4 All’atto del pagamento dell’intero importo sarà inviata al cliente, anche tramite posta elettronica all’indirizzo indicato dal cliente, regolare fattura a saldo.
7.5 Clausola risolutiva espressa: il mancato pagamento da parte del cliente entro il termine di 9 (nove) giorni comporterà l’automatica risoluzione del contratto; pertanto Trends Forecasting S.r.l. potrà eliminare il cliente dalla piattaforma senza alcun preavviso e senza alcuna comunicazione al riguardo.
8) Dichiarazioni, garanzie e responsabilità
Il sito www.tjfgroup.com ed il servizio online sono gestiti da Trends Forecasting S.r.l. con la massima attenzione, affidabilità e professionalità.
Il Fornitore dichiara che al meglio delle sue conoscenze l’uso dei materiali secondo le norme di cui al presente contratto non lede diritti di terzi.
Fermo restando quanto sopra, il Fornitore esclude espressamente, in relazione ai materiali, così come ai file che li contengono, ogni garanzia e condizione, espressa, implicita o statutaria, incluse, fra le altre, le garanzie implicite e/o le condizioni di commerciabilità, di qualità soddisfacente, di idoneità al soddisfacimento di uno scopo specifico, di esenzione da vizi o difetti, di precisione.
Si fa presente che Internet non é posseduta dal Fornitore che pertanto non si farà carico di eventuali accessi al server in cui vengono ospitati i siti di TJF Group da parte di un utilizzatore qualsiasi.
Il Fornitore si impegna comunque a rimediare con la massima sollecitudine ad eventuali guasti di rete o ad altri malfunzionamenti come ad esempio anomalie nel collegamento telematico, anomalie del circuito internet, anomalie derivanti da cause di forza maggiore, da comportamenti colposi di terzi.
Il Fornitore non può inoltre garantire che il servizio sia sempre accessibile senza interruzioni e che si possa sempre instaurare la connessione richiesta.
Il Fornitore, inoltre, qualora sia necessario effettuare lavori di manutenzione ordinaria o straordinaria del sito, potrà sospendere temporaneamente la sua (o le sue) rete telecomunicativa od a limitarne la durata.
Sono escluse eventuali richieste di risarcimento danni nei confronti di Trends Forecasting S.r.l.., salvo che il danno derivi da dolo o colpa grave.
Il Fornitore non si assume alcuna responsabilità relativamente alla veridicità dei dati inseriti dal cliente finale nella sua richiesta, in particolare sulla reale esistenza del cliente finale sotto il nome e l’indirizzo specificati.
9) Responsabilità del contraente per l’accesso tramite il suo Ip, l’uso di Id e di password
Il contraente è obbligato nei confronti del Fornitore ad attenersi alla massima diligenza nell’uso e nella custodia dell’Id e della password assegnati e alla sicurezza dell’Ip dichiarato ed è pertanto responsabile di tutte le conseguenze connesse all’eventuale loro uso abusivo o contrario alle norme di cui al presente contratto. In caso di smarrimento, di furto o di fondato timore che l’Id o la password assegnate (ovvero la sola password) siano venute a conoscenza di terzi, il contraente è tenuto a darne immediata comunicazione al fornitore affinché lo stesso provveda, nel minor tempo tecnicamente richiesto, a una nuova assegnazione o configurazione. Il fornitore si riserva la facoltà di sospendere le autorizzazioni di accesso fino al loro ripristino. Salve le norme inderogabili di legge, il fornitore non è in ogni caso responsabile dei danni che possano derivare al contraente per l’uso improprio degli strumenti di autenticazione dell’accesso.
Il fornitore si riserva di sospendere o revocare le autorizzazioni concesse in caso di violazione degli obblighi assunti dal contraente ai sensi del predetto contratto e di ogni disposizione contrattuale o di legge, generale o speciale, di disciplina dell’accesso ai materiali.
10) Privacy
Nel rispetto del Codice in materia di protezione dei dati personali (D.Lgs. 196/03), Trends Forecasting S.r.l. garantisce la massima riservatezza nel trattamento, manuale ed informatico, dei dati personali, utilizzati per l’ordinaria gestione commerciale e per l’invio di cataloghi e altro materiale gratuito, oltre che, ove specificamente indicato nelle singole sezioni web, per altre finalità ivi espresse e correlate alla fruizione dei servizi specificamente richiesti dall’interessato. Per lo svolgimento dell’attività il Fornitore si avvale dei propri dipendenti e di soggetti esterni incaricati, o responsabili, di trattare i dati per le predette finalità.
Il cliente presta il suo consenso al fatto che tutti i dati personali necessari alla sottoscrizione dell’abbonamento ed all’accesso ai materiali riservati presenti sul portale www.tjfgroup.com vengano elaborati e memorizzati informaticamente.
Il cliente gode dei diritti di cui all’art. 7 del D.Lgs. citato, in virtù dei quali potrà chiedere ed ottenere, tra l’altro, informazioni circa i dati che lo riguardano e circa le modalità o le finalità del trattamento; potrà anche chiedere l’aggiornamento, la rettifica, l’integrazione, la cancellazione, l’anonimizzazione ed il blocco dei dati e potrà infine opporsi al trattamento degli stessi. Tali diritti dovranno esercitati rivolgendosi al Titolare del trattamento, la società Trends Forecasting S.r.l., via Einstein 16/A, 52100 Arezzo.
11) Legge applicabile, conciliazione ed arbitrato
Il presente contratto è soggetto alla legge italiana ovvero a quella del paese del contraente qualora quest’ultima imponga la sua applicazione ai fini del riconoscimento della validità e/o dell’efficacia del presente contratto.
Tutte le controversie derivanti dal presente contratto, comprese quelle relative alla sua validità, interpretazione, esecuzione e risoluzione, saranno devolute al tentativo di conciliazione previsto dal Servizio di Conciliazione Online della Camera Arbitrale di Arezzo Nel caso in cui il tentativo di conciliazione non fosse raggiunto, la controversia sarà risolta da un arbitro unico, in conformità al Regolamento della Camera Arbitrale di Arezzo che può essere consultato sul sito………..La sede dell’arbitrato è fissata presso la Camera Arbitrale di Arezzo . L’arbitro unico deciderà in via rituale e secondo diritto.
12) Disposizioni finali
Eventuali modifiche e/o integrazioni al presente contratto dovranno essere approvate per iscritto da entrambe le parti.
Per tutte le controversie con i consumatori resta salva l’applicazione delle norme imperative di legge in materia di competenza giurisdizionale e di legge applicabile.
Le presenti condizioni contrattuali sono state redatte in lingua italiana. Qualora la traduzione in lingua inglese possa portare ad errori di interpretazione o ad altri errori, fa fede la versione italiana.
AGREEMENT CONDITIONS FOR SUBSCRIBING TO TJF MAGAZINE AND TJF TREND BOOK
1) Introduction
The agreement hereof refers to the rules and regulations relative to e-commerce. 2) Definitions
For agreement purposes, the following terms are understood and interpreted as follow:
a) The “Supplier” is the Firm Trends Forecasting S.r.l.
b) The “Contracting Party” is the individual or legal person (company, association, institution, record office, etc.) in the place of the legal representative pro tempore, who makes the Order;
c) “Order summary” is a document, including electronic ones; this document contains indications about the price for the services and the payment terms. The Order summary is an integral part of the agreement hereof;
d) An “Order” is a document that is sent by computer and is where the contracting party attests its willingness to make a contractual offer according to the specifications indicated on the Order Summary and according to the contractual conditions agreed for the year in which the subscription is requested. An Order is an integral part of the agreement hereof;
e) “Order Receipt” is a communication sent by the supplier to the contracting party, wherein it confirms the acceptance of the Order. The Order Receipt is an integral part of the agreement hereof;
f) “Materials” are the contents, under any form or expression, entirely or in single parts, that are made available to the contracting party through a network, upon its own request; the contracting party is provided with a user licence, which is not exclusive under the terms and conditions established on this agreement;
g) “Current Materials” are materials that account for the electronic versions (files) of the whole series of articles that are published in the magazine, which the contracting party subscribes to and relatively to the number of the magazines purchased with the yearly subscription, which are effective under the formula "paper + on line";
h) “Magazines” are the magazines that are published by the Supplier.
3) Subject-matter and Period
The agreement’s subject-matter is alternatively or cumulatively the subscription to TJF Magazine, TJF Trend Book and the access to additional materials and services that are available on the website www.tjfgroup.com.
By signing the subscription, the user can access the reserved sections of the chosen magazine for the period corresponding to that of the selected subscription, effective from the date in which the password is provided.
Once the user subscribes and pays the respective price, the subscriber will be provided (by email) with a user name and a password so that it can access the reserved sections of the selected magazine. After the subscription expires, the access granted to the reserved sections of the magazine may stop immediately without receiving a prior notice from the supplier.
4) Improvement and effectiveness
This electronic agreement will be completed when the supplier accepts the Order that is sent by the contracting party by means of computer. The party who applies shall select the magazine that wishes to subscribe to and the respective subscription period; click on the "order" button and fill out the subscription form. The supplier will confirm the subscription with a communication stating that the agreement will be completed and it will forward it with an email sent to the email address that the applicant listed on the subscription form.
The effect of this agreement will be pending until the contracting party registers through the supplier's website. The Supplier will also send a pro-forma invoice for the services offered, it shall be paid by no later than 9 (nine) days, otherwise the agreement will be considered automatically annulled.
5) Execution
The access to the reserved sections is done by authenticating the contracting party’s Internet Protocol (IP) number, as declared by the contracting party. The contracting party’s IP number must refer to a single computer or network.
Any violation to the agreement made on the nature and the characteristics of the contracting party’s IP and/or local network will account for a serious non-fulfilment by the contracting party and will justify the termination of the agreement because of such offence.
If the contracting party is an individual who operates for purposes other than entrepreneurial activity or professional activity, the agreement will be then subjected to articles 50 ss. of Legislative Decree dated September 2005 and article no. 206 “The Consumer Code”.
6) User licence and copyrights
All materials are subjected to intellectual property rights and/or patent rights and belong to Trends Forecasting S.r.l. With the exception of what is authorized under this agreement, any act of national or international laws reserved to the proprietor and that are carried out without the proprietor’s authorization will be prosecuted under civil or criminal proceedings.
The materials in the reserved area are granted under the user licence, which is not exclusively and cannot be transferred according to the following specifications:
a) The material may only be copied digitally once. Such copy may be downloaded from the website. Any additional digital, electronic or magnetic copy, either total or partial is forbidden;
b) The materials may only be printed by authorized Users and for strictly personal purposes, without profit and may not be used for commercial purposes, directly or indirectly.
c) The materials and/or its usage may not be modified in any way to work with derived, composite or complex activities without prior written authorization provided by Trends Forecasting S.r.l.
Any copied material must maintain the information relative to the copyright legal ownership.
Trends Forecasting S.r.l. reserves the right to suspend the subscription immediately if supplied illegitimately.
7) Price and Payment Terms
7.1 Subscribing to TJF Magazine.
The yearly subscription for the magazine is equal to 5 issues and costs € 56.00.
A two-year subscription to the magazine costs € 106.00.
Prices include taxes and shipping charges. If prices need to be converted into pounds or dollars they shall be subjected to the exchange rate at the time of the subscription.
7.2 Subscribing to TJF Trend Book.
The subscription to TJF Trend Book 2009 + TJF Trend Book 2008 + TJF Trend Book 2007 + a year’s free subscription to TJF Magazine costs € 1,1000.00.
Thee subscription to TJF Trend Book 2007 (while stocks last) costs € 100.00.
The subscription to TJF Trend Book 2008 + a year’s free subscription to TJF Magazine costs € 400.00.
The subscription to TJF Trend Book 2009 + a year’s free subscription to TJF Magazine costs € 750.00.
Prices include taxes and shipping charges. If prices need to be converted into pounds or dollars they shall be subjected to the exchange rate at the time of the subscription.
7.3 The payment shall be paid by no later than 9 (nine) days after receipt of an email from TJF Group therein stating the subscription confirmation, which also includes a pro forma invoice for the services.
The payment shall be made as follow:
a) by means of a bank transfer to the current account in the name of Trends Forecasting srl at Banca Etruria Arezzo, Agency 12 Branch, Swift: ARBAIT33148, Abi (Italian Banking Association): 05390, Cab (Bank Sorting Code): 14112, IBAN: IT15R0539014112000000001112.
b) By credit card
7.4 When the payment is paid in full, the customer will also receive a standard invoice, it will be sent to the email address that was indicated by the customer.
7.5) Expressed resolutive clause: if the customer does not make the payment within 9 (nine) days, the agreement will be automatically terminated and therefore Trends Forecasting S.r.l. can remove the customer from the platform without giving any prior notice.
8) Declarations, guarantees and obligations
The website www.tjfgroup.com and the online services are managed by Trends Forecasting S.r.l with the utmost care, reliability and professionalism.
The Supplier declares that to the best of its knowledge, the use of the materials according to standards on the agreement hereof, does not harm third parties rights.
In consideration of the above stated, the Supplier explicitly excludes any expressed, implied or statute warranties or conditions about the materials and files that contain them, including among others, implied warranties and/or commercial conditions, acceptable quality conditions, conditions that fulfil a specific goal and conditions that exempt accuracy defects or faults.
Please note that the Internet is not owned by the Supplier and therefore it will not be liable for any access to the server wherein websites from TJF Group are hosted by any user.
In any case, the Supplier commits itself to remedying any network failures or any other malfunctioning with the utmost promptness, as for example, connection problems, internet circuit problems, issues due to force majeure and problems due to third parties behaviour without malice aforethought.
Moreover, the Supplier cannot guarantee that the service will always be accessible without interruptions and it cannot ensure that the connection requested will always be established.
If ordinary or extraordinary maintenance need to be carried out on the website, the supplier may temporarily interrupt the network/s or limit its period.
Any compensation for damages against Trends Forecasting S.r.l. are not admitted, except if the damage is due to fraud or gross negligence.
The Supplier will not be held liable in any way for the veracity of the data input by the final customer on its request, especially for the actual existence of the final customer under such specified name and address
9) The contracting party’s obligations for accessing using its IP, ID and password
The contracting party must be very careful while using and keeping the ID and the password that are provided by Trends Forecasting S.rl., as well as the declared IP; the user is therefore liable for all consequences linked with any “abusive" use that does not comply with the regulations of this agreement. If they are lost, stolen or if the user fears that a third party has come to know the ID or password, the user must then inform Trends Forecasting S.r.l immediately so that they can assigned a new password or configure it in the shortest time technically required. The supplier reserves the right to suspend access authorizations until they are restored. In any case, with the exception of binding regulations, the Supplier is not liable for damages that may result to the contracting party for the improper use of access authentication tools.
The supplier reserves the right to suspend or revoke authorizations that are granted to the contracting party, in case the user violates its assumed obligations made in accordance with the aforesaid agreement and in accordance with any contractual disposition, law regulation, either general or special or rules to follow for accessing the materials.
10) Privacy
In order to comply with the Code concerning the protection of personal data (Legislative Decree 196/03), Trends Foreasting S.r.l guarantees the utmost privacy for the treatment of data, either manually and by means of a computer, that is used for normal commercial management and used for sending catalogues and other free of charge materials, as well as, wherein specifically requested on the single web sections, it may be also be used for other purposes, therein expressed and connected to the rendering of services that is specifically requested by the interested party. In order to carry out such activities, the Supplier uses its own employees and external assigned subjects or persons in charge for handling the data for such purposes.
The customer gives its consent to the fact that all personal data required for the subscription and to gain access to the reserved materials available on the website www.tjfgroup.com will be processed and stored by means of a computer.
The customer is entitled to the rights mentioned on article 7 of Legislative Decree, wherein it can request and obtain, among other things, information about the data that concerns the customer and data about the procedures and the purpose of the treatment; it may also request to update, correct, add, delete or be anonymous and obstruct the data and can eventually oppose the treatment of the data itself. These rights must be exercised by contacting the subject in charge of the data treatment, Trends Forecasting S.r.l, via Einstein 16/A, 52100 Arezzo.
11) Applicable laws, settlement and arbitration
The agreement hereof is subjected to Italian laws, or to the laws wherein the user resides if the latter imposes its application for purposes of recognizing the agreement’s validity and/or effectiveness.
Any disputes derived from this agreement, including those relative to its validity, interpretation, execution and termination, will try to be settled according to the Online Settlement Service of the Arbitration Board of Arezzo If the attempt for settlement is not possible, the dispute will be settled by a sole arbitrator, in accordance with the Regulations of the Arbitration Board of Arezzo , which can be looked up on the website ........... The arbitration location will be arranged by the Arbitration Board of Arezzo The sole arbitrator will settle the disputes through a ritual arbitration and a rights arbitration.
12) Final Provisions
Any modifications and/or additions made to this agreement must be approved in writing by both parties.
All disputes with consumers will apply to binding laws of legal competence and applicable laws.
The contractual conditions hereof have been written in the Italian language. If the English translation leads to interpretation errors or any other type of errors, then the Italian version shall prevail.
